These Terms of Service ("Terms") govern your access to and use of the Inspector.AI platform, including the website at inspector.ai, associated subdomains, mobile-optimized pages, and API services (collectively, the "Platform"), operated by Inspector.AI ("Company," "we," "us," or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1. Acceptance and Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform. By creating an account, you confirm that you meet these requirements and that all information you provide is accurate and complete.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting an updated version with a new "Last updated" date. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

2. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Promptly notifying us of any unauthorized access at hello@inspector.ai
  • Ensuring your account information remains accurate and up to date

You may not share your account credentials, create accounts on behalf of others without authorization, or use the Platform for any unlawful purpose.

3. Bookings and Payments

3.1 Booking Process

The Platform allows homeowners and real estate professionals to book home inspections directly with licensed inspectors. A booking is confirmed when the inspector accepts or when the system auto-confirms per the inspector's availability settings.

3.2 Payment Terms

Payment is processed at the time of booking or upon invoice, as configured by the inspector. All payments are processed by Stripe. By providing payment information, you authorize us (and Stripe on our behalf) to charge the amount displayed at checkout, including applicable service fees.

3.3 Refunds and Cancellations

Cancellation and refund policies are set by the individual inspector and displayed during the booking flow. Inspector.AI's platform fee (if any) is non-refundable once a booking is confirmed. Disputes about inspection quality are between the homeowner and the inspector; Inspector.AI may facilitate resolution but is not obligated to issue refunds for services rendered by inspectors.

3.4 Inspector Payouts

Inspectors who receive payments through the Platform via Stripe Connect are subject to Stripe's Connected Account Agreement. Payouts are subject to Stripe's standard processing timelines. Inspector.AI is not responsible for delays caused by Stripe or financial institutions.

4. Inspector and Platform Roles

4.1 Independent Contractors

Inspectors listed on the Platform are independent contractors, not employees, agents, or partners of Inspector.AI. Inspector.AI does not supervise, direct, or control inspection work. Each inspector is solely responsible for the quality, accuracy, completeness, and legality of their inspections.

4.2 Inspector Obligations

By listing on the Platform, inspectors represent and warrant that they:

  • Hold all required licenses, certifications, and insurance for their jurisdiction
  • Will maintain license and insurance currency for the duration of their listing
  • Will perform inspections in a professional manner consistent with applicable standards
  • Will not misrepresent their qualifications, pricing, or service area

4.3 Platform Role

Inspector.AI provides technology to facilitate discovery, booking, communication, payment, and report delivery. We do not verify or guarantee the accuracy of any inspection report. We are a marketplace platform, not an inspection company.

5. Prohibited Conduct

You agree not to:

  • Violate any applicable law or regulation
  • Post false, misleading, or fraudulent content, including fabricated reviews
  • Circumvent our booking system to conduct transactions off-platform in order to avoid fees
  • Scrape, crawl, or harvest data from the Platform without written permission
  • Reverse engineer, decompile, or attempt to extract source code from the Platform
  • Interfere with the Platform's operation, security, or infrastructure
  • Use the Platform to send unsolicited commercial communications (spam)
  • Impersonate another person, inspector, or entity

Violation of these prohibitions may result in immediate account suspension or termination at our sole discretion.

6. Intellectual Property

6.1 Our Intellectual Property

The Platform, including its software, design, logos, trademarks, and content created by Inspector.AI, is our exclusive property. You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purposes. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

6.2 Your Content

You retain ownership of content you submit (e.g., inspection reports, profile text, photos). By uploading content to the Platform, you grant Inspector.AI a worldwide, non-exclusive, royalty-free license to store, display, and distribute that content as necessary to operate the Platform and provide services to you. You represent that you have the rights to grant this license and that your content does not infringe any third-party rights.

7. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

INSPECTOR.AI MAKES NO WARRANTY REGARDING THE QUALITY, ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY INSPECTION PERFORMED BY INSPECTORS ON THE PLATFORM. AI-GENERATED CONTENT (SCHEDULING SUGGESTIONS, MESSAGE DRAFTS, REPORT SUMMARIES) IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL JUDGMENT.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INSPECTOR.AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR ANY INSPECTION SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO INSPECTOR.AI FOR PLATFORM SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to indemnify, defend, and hold harmless Inspector.AI and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any inspection you perform or commission through the Platform.

10. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law principles. Any dispute not subject to arbitration (see Section 11) shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.

11. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

For any dispute or claim arising out of or relating to these Terms or the Platform (a "Dispute"), you and Inspector.AI agree to first attempt to resolve it informally by contacting us at legal@inspector.ai. If the Dispute is not resolved within 30 days, either party may elect to resolve it through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.

Class Action Waiver: You agree to resolve Disputes on an individual basis and waive the right to participate in any class, collective, or representative proceeding.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or confidential information.

12. Account Termination

You may close your account at any time by contacting us. We may suspend or terminate your account at our sole discretion, with or without notice, if we believe you have violated these Terms or posed a risk to the Platform or other users. Upon termination, your right to use the Platform ceases immediately, though provisions that by their nature should survive (including Sections 6–11) will remain in effect.

13. Modifications to the Platform

We reserve the right to modify, suspend, or discontinue any feature or aspect of the Platform at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

14. Miscellaneous

  • Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Inspector.AI regarding the Platform and supersede all prior agreements.
  • Severability. If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.
  • Waiver. Failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
  • Assignment. You may not assign your rights under these Terms without our written consent. We may assign our rights without restriction.
  • Force Majeure. We are not liable for failures caused by events beyond our reasonable control, including natural disasters, power outages, or third-party service failures.
